Capacity is a professional learning tool. It is here to help you consume, retain, and apply knowledge more effectively. A few things to know upfront:

We process your content. We do not own it.

We generate AI summaries. You verify what matters.

We protect your data. You protect your clients'.

You can cancel anytime. No runaround.

1. Acceptance of Terms

By creating an account and using Capacity, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the platform.

These terms apply to all users of capacityworks.co, including individual subscribers, enterprise account members, and trial users.

2. What Capacity Is — and Is Not

Capacity is:

  • An AI-powered platform for processing, synthesizing, and personalizing professional learning content
  • A tool to help you consume information more efficiently and apply it more effectively
  • A subscription service operated by Over Work

Capacity is not:

  • A legal advisory service
  • A medical or clinical platform
  • A financial advisory service
  • A compliance certification system
  • A substitute for professional judgment in any regulated field

AI-generated summaries are tools to support your thinking — not replacements for it. Always verify information that matters before acting on it professionally.

3. Your Account

Eligibility

You must be at least 18 years old and capable of entering a binding agreement to use Capacity.

Account security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at capacity@overworkonline.com if you suspect unauthorized access.

Accurate information

You agree to provide accurate information when creating your account and to keep it current.

One account per person

Individual accounts are for one person only. Enterprise accounts are governed by separate agreements.

4. Acceptable Use

You agree to use Capacity only for lawful professional development purposes. You may not use Capacity to:

  • Upload, process, or distribute content that promotes violence, terrorism, or extremist ideologies
  • Upload, process, or distribute sexually explicit material
  • Upload personally identifiable information about clients, patients, students, policyholders, or customers without their explicit consent
  • Violate any applicable law or regulation
  • Attempt to reverse engineer, scrape, or extract data from the platform
  • Share your account credentials with others
  • Use the platform to harm, harass, or deceive any person

Regarding regulated professions: If you work in education, healthcare, legal, mental health, insurance, finance, or any other regulated field, you are solely responsible for ensuring your use of Capacity complies with all applicable professional regulations, including but not limited to FERPA, HIPAA, attorney-client privilege rules, and applicable state and federal financial regulations. Capacity provides general compliance reminders as a courtesy — these are not legal advice and do not constitute compliance certification.

We reserve the right to remove content that violates these terms and to suspend or terminate accounts that repeatedly or egregiously violate our community standards.

5. Content You Submit

What you submit

Capacity allows you to submit two types of content for processing:

  • Your original content — documents, recordings, frameworks, and materials you have created and own
  • Third-party content — articles, books, podcasts, social posts, and other materials authored by others that you have lawful access to

Your original content

You retain full ownership of any content you have created. When you submit your original content to Capacity, you grant Over Work a limited, non-exclusive, royalty-free license to process it for the sole purpose of generating your personalized summaries and results. This license ends when you delete the content or close your account.

Third-party content

When you submit content authored by others, you represent that you are accessing and submitting that content lawfully — for example, through a valid subscription, a publicly available source, or under applicable fair use principles. Capacity processes third-party content on your behalf as a personal learning tool. We do not store, redistribute, or republish third-party content beyond what is necessary to generate your personal summaries.

Your responsibility

You are responsible for ensuring that any content you submit — whether your own or third-party — does not violate any applicable law, intellectual property right, or professional obligation. Do not submit content you do not have the right to access or process.

AI-generated results

Summaries, digests, and other outputs generated by Capacity are derived from the content you submit and the AI models we use. We do not guarantee the accuracy, completeness, or fitness for any particular purpose of AI-generated outputs. Always apply your professional judgment and verify information that matters before acting on it.

6. Subscriptions and Payments

Billing

Capacity is offered on monthly, quarterly, and annual subscription plans. Prices are displayed at capacityworks.co and may change with notice.

Automatic renewal

Subscriptions renew automatically at the end of each billing period. You authorize us to charge your payment method on file for each renewal.

Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You will retain access until then.

Refunds

We do not offer refunds for partial billing periods. If you experience a technical issue that prevents you from using the platform, contact us at capacity@overworkonline.com and we will work with you to find a fair resolution.

Free trial

New users receive a free trial period as described at signup. No credit card is required to start a trial. At the end of the trial, you will be prompted to select a paid plan to continue.

Price changes

We will provide at least 30 days notice before increasing prices for existing subscribers. You may cancel before the new price takes effect.

7. Intellectual Property

Our platform: The Capacity platform, including its design, code, features, and brand, is owned by Over Work and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from our platform without written permission.

Your content: As stated above, you own your content. We claim no intellectual property rights over what you submit.

AI outputs: Summaries and other AI-generated outputs are provided to you for your personal and professional use. You may use, share, and publish them. We do not claim ownership of outputs generated from your content.

8. Disclaimer of Warranties

Capacity is provided "as is" and "as available." We make no warranties, express or implied, regarding the platform's reliability, accuracy, fitness for a particular purpose, or uninterrupted availability.

We do not warrant that AI-generated summaries are accurate, complete, or suitable for any specific professional purpose. You use the platform and its outputs at your own discretion and risk.

9. Limitation of Liability

To the maximum extent permitted by law, Over Work shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Capacity, including but not limited to decisions made based on AI-generated content, data loss, or service interruptions.

Our total liability to you for any claim arising from these terms or your use of Capacity shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Over Work, its officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of Capacity, your violation of these terms, or your violation of any third-party rights.

11. Termination

By you

You may close your account at any time from your account settings.

By us

We may suspend or terminate your account if you violate these terms, engage in fraudulent activity, or use the platform in a way that harms other users or Over Work. We will provide notice where reasonably possible.

Effect of termination

Upon termination, your access to the platform ends. Your data will be deleted in accordance with our Privacy Policy.

12. Governing Law and Dispute Resolution

These terms are governed by the laws of the State of Ohio, United States, without regard to conflict of law principles.

For US users: Any disputes arising from these terms or your use of Capacity shall be resolved in the state or federal courts located in Ohio. You consent to the personal jurisdiction of such courts.

For UK and EU users: Nothing in these terms affects your statutory rights under applicable UK or EU consumer protection law. Where required by applicable law, disputes may be resolved through your local courts or alternative dispute resolution mechanisms.

For all users: Before initiating any formal dispute, we encourage you to contact us at capacity@overworkonline.com. We will make every reasonable effort to resolve concerns informally within 30 days.

13. Changes to These Terms

We may update these terms from time to time. We will notify you of material changes by email and by displaying a notice on the platform at least 14 days before changes take effect. Continued use after changes take effect constitutes acceptance.

How We Access Third-Party Content

Capacity is designed to help you learn from content you choose to engage with. When you submit a link from a third-party platform — such as YouTube, Vimeo, or a news article — we attempt to retrieve the text or transcript of that content so it can be processed through the Capacity Learning Framework.

We only access content through legitimate, publicly available means: official transcript APIs, published captions, and licensed web scraping tools that respect robots.txt and platform terms of service. We do not extract audio from videos, bypass paywalls, or circumvent authentication systems.

Some platforms — including major social media and video networks — actively restrict automated access to their content, even for legitimate learning purposes. When a video or page cannot be accessed within these boundaries, Capacity will let you know clearly rather than work around those restrictions.

We believe that doing things the right way — the same way we handle your personal data with care and consent — is not optional. If a platform makes access difficult or impossible within fair use, we will always tell you honestly rather than find a workaround that compromises our values or exposes you to risk. We are continually working to expand the range of content we can process responsibly.
